Tribal Employment Rights Ordinance

Important Information for Persons or Companies Providing Goods or Services on Tribal Lands
Any persons or companies providing goods or services on Tribal Lands must provide an employment preference to qualified members of the Mashpee Wampanoag Tribe and other Native Americans.
Here are some key points about the employment preference:
The preference applies to any person or company providing material or equipment or performing work or services on Tribal Lands (known as "Vendors")
The Tribal Lands include all land (known us "Trust Lands") in Mashpee or Taunton held by the U.S. Government in trust for the Tribe, all lands contiguous to Trust Lands and all other land over which the Tribe has authority.
The employment preference applies to employees of Vendors, but not to persons hired by Vendors who are independent contractors.
To qualify for an employment preference a Tribal member must have the appropriate qualifications.
Important Information About the TERO Preference for Companies Owned by Tribal Members or Other Native Americans
The TERO Ordinance provides a preference for Vendor Companies who are owned by Tribal members or other Native Americans
Here is some important information about the Vendor preference:
To qualify for the certification the Company must have existed for at least one year prior to the certification.
Certification requires at least 51% ownership by Tribal members or other Native Americans.
The Tribal members or other Native Americans must control all important decisions of the company.

The TERO office is responsible for the enforcement and administration of the Mashpee Wampanoag Tribal Employment Rights Ordinance (TERO) - 2012-0RD-001.
The Mashpee Wampanoag Tribal Council has identified the need to create employment, employment training, education, contracting, and subcontracting opportunities for Tribal Members and for Native Americans who are not Tribal members.
The Mashpee Wampanoag TERO office will assist in creating, identifying and connecting qualified Native Americans to employment and enterprise opportunities within our Sovereign Nation.
The TERO Office is required to enforce and inform all employers or their responsibility to comply with the TERO Ordinance. The Mashpee Wampanoag Tribe and employers active with in the nation are required to give preference to qualified Natives in hiring, promoting, training, temporary layoffs and all aspects of business activities.
The TERO Office will also manage the process of certifying Tribal member and Native American owned and controlled entities for Contractor Preference.
