Court Clerk

This position is a full-time position funded by the BIA.   The Court Clerk is responsible for preparation, maintenance and closing of all case files. Additional duties include implementation of court automation, accounting and maintaining all public information systems.  The Court Clerk will maintain a compilation of financial and statistical reports and maintain the Law Library.

Essential Job Duties:

•       To undertake all duties and functions otherwise authorized for the clerk by Tribal law, or necessary and proper to the exercise of a duty or function authorized by Tribal law.

•       To accept, when ordered by the Court, monies for the payment of civil judgements and to pay same by check to the party entitled to them.

•       To administer oaths, issue summons and subpoenas and certify a true copy of Court records, and to accurately keep each and every records of the Supreme Court and District Court, and such other lower courts as shall be established.

•       To assist in providing a record to accurately and completely record all proceedings and hearings of the Courts.

•       To provide stenographic and clerical service to the Court.

•       To assist in all grants awarded.

•       To act as Librarian, and to keep and maintain the Court’s Law Library.

•       To undertake all duties assigned or delegated to the Clerk’s office by Tribal law or Court Rule.

•       To work co-operatively with the Elders Judiciary Committee (EJC), Judges, and Court Administrator. To carry out all duties assigned by the Court Administrator.

  • Individual must be of high moral character and integrity.

  • Must have a high school diploma or its equivalent.

  • Must be computer literate, including proficient at word processing, Excel and Database Management.

  • Must be physically able to carry out the duties of the office.

  • Must be free of any conviction of a felony or crime of moral turpitude.

  • Must be willing to work with Court Personnel in all duties as assigned.

  • Must be dependable, conscientious, have the capacity to be an innovative thinker, and commit to obtain a deep understanding the goals of the future growth of Tribal Court.

  • Must possess a valid driver’s license and pass a CORI/background check and toxicology screening.

Preference is given to qualified Native American candidates in accordance with the Indian Preference Act of 1934 (Title 25, U.S.C, and Section 472).

Internships

2023 INTERNSHIP DESCRIPTION

The Mashpee Wampanoag Tribal Court offers the opportunity for one intern to become directly involved in the broad range of legal and policy matters that come into the Tribal Court. We hope to create a challenging and interesting experience for an intern. Our small environment enables an intern to experience a wide range of federal Indian law issues common to all tribes, as well as those issues unique to the Mashpee Wampanoag people that arise from its current federal Indian status. Such cases include sovereign immunity, member status and enrollment, election appeals and traditional peacemaking.

A legal intern would be expected to be able to conduct research projects and draft memorandum with appropriate supervision from the Chief Judge and the Elders Judiciary Committee. In addition, the intern may be called upon to draft correspondence, track pending legislation, and to otherwise assist the Court staff with their duties. 

In 2023, we anticipate selecting one intern for the summer which will include a weekly stipend. Solid writing skills and an interest in Federal Indian Law are essential, and we strongly prefer second or third-year students. Interested parties are responsible for their own transportation and accommodations.
